In 1998 the Foster Creek Conservation District (FCCD) Board of Supervisors became concerned about the potential for agricultural activities to become regulated as a consequence of recent and proposed listings of fish and wildlife species under the FESA. Although effects on agricultural activities in Douglas County were assumed not significant at the time, the listing of fish and wildlife were impacting landowners elsewhere in the Pacific Northwest .  The occurrence of several wildlife species in Douglas County that were already federally designated as Candidates or Species of Concern under the FESA indicated there was a very real possibility for additional wildlife species occurring in Douglas County to be designated as Endangered or Threatened under the FESA.  Should greater sage grouse, sharp-tailed grouse, white-tailed jack rabbit or Washington ground squirrel ever be listed (pygmy rabbits were listed as Endangered in 2003), landowners recognized that regulatory actions might be implemented in Douglas County that could significantly reduce their ability to continue agricultural production management activities.
