Takings Issue
ID # 611
Authors James R. Pease
Publication Date January 1998
Produced By Oregon State University
Summary The right to own and use
private property is a cornerstone of the American Dream. However, the idea that
we can use our property
in any way we choose is not, and never has been, a constitutional right. On the
other hand, the
government cannot, in the name of the public welfare, enact and enforce any
restriction it
chooses on the use of
private property. There probably is no public policy issue more controversial
today
than the "takings
issue", especially in rural areas. But, what are the facts and what are
the popular fictions
regarding our
constitutional rights to own and use property, and what are our land
stewardship
responsibilities to
others in our society? This publication discusses both sides of this question
from the
perspective of judicial
interpretations of our Fifth Amendment rights.
